Why Marcel? Myths & FaQs

1 - You can't recover compensation in Ontario for car accident claims.

NOT SO! There is lots of potential where your injuries are serious or where you have suffered major economic loss (i.e., business or income losses). As well most people can get benefits from their own insurance company.

2 - The insurance adjustor has already offered me money. He told me I'll end up with much more in my pocket, and get the money now, as lawyers can drag a case out and at the end there are hefty legal fees to pay.

Whose side is the insurance adjustor on? Exactly. Do you think an insurance company will just throw money at you? Get the facts from someone who will be on your side.

3 - The accident was my fault. My case is therefore hopeless. Do I still need a lawyer?

You may still have some cards to play with. As well, fault will not affect your claim for benefits. Discuss it with me.

4 - I'm afraid of going to court. Will seeing a lawyer automatically send my case to court?

About 95% of cases never see a courtroom. They settle. Suing somebody does not mean you end up in court. I'll bet you were not aware of this.

5 - Why see a lawyer? I heard a case could take years to finish.

Many cases do take a while to resolve because the client is seriously injured and it takes time until he or she feels better and we can asses the claim. I will, however, recover the maximum settlement when the case is ripe for discussion.

6 - Do I have deadlines?

Personal injury cases are full of deadlines. Car accidents are different than slip and falls. Only a lawyer can explain them to you. If you should ever slip on a municipal sidewalk, for example, you have only 7 days to notify the city clerk's office in writing of your claim. You will cry the blues if you miss it. It will not help you to say, "How would anybody know that?"

7 - Who pays my legal fees?

Glad you asked. A large chunk of the fees are paid by the insurance company in most cases. The client pays the rest out of the settlement. I would be pleased to discuss this with you.
